Terms of Service

These Terms of Service ("Terms") govern your access to and use of Tracemetry, operated by Ankan Systems ("we", "our", "us"). By creating an account or using the service you agree to these Terms.

1. The Service

Tracemetry is a software-as-a-service product that tracks how brands appear in AI search answers (including but not limited to ChatGPT, Claude, and Perplexity), identifies content gaps, and generates content briefs and drafts to address those gaps. The service depends on third-party AI providers and the answers they return may change without notice.

2. Account & Eligibility

You must be at least 18 years old and have authority to bind your organization. You agree to provide accurate information, keep your credentials secure, and to be responsible for all activity on your account. We may suspend or terminate accounts for fraud, abuse, or violation of these Terms.

3. Billing

Paid plans are billed in advance through Stripe. Fees are non-refundable except where required by law or as we otherwise communicate in writing. You can cancel at any time via the customer portal; access continues through the end of the current billing period.

4. Acceptable Use

You will not use the service to: (a) crawl, ingest, or analyze content you do not have rights to use; (b) target individuals; (c) generate content that is unlawful, defamatory, infringing, or deceptive; (d) circumvent rate limits or attempt to access other customers' data; (e) resell the service without our written permission.

5. Your Content

You retain ownership of the data, sources, briefs, and drafts associated with your workspace ("Customer Content"). You grant us a limited license to process Customer Content solely to provide the service. We do not use Customer Content to train third-party foundation models.

6. Our Service Marks

Tracemetry, our logos, and the look-and-feel of the service are our intellectual property. We grant you no rights to them other than the right to use the service.

7. Third-Party Providers

The service integrates third-party providers including Supabase, Stripe, Resend, OpenRouter, Exa, Firecrawl, and others. Your use of those providers is governed by their terms. We are not responsible for outages, errors, or changes in those providers.

8. AI Output Disclaimers

Generated briefs, drafts, opportunity rationales, and visibility analyses are produced with the help of large language models. They may contain errors, hallucinations, or outdated facts. You are responsible for reviewing AI-generated output before publishing or relying on it. We do not warrant that any AI output is fit for any particular purpose.

9. Warranty Disclaimer

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim relating to the service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

11. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access for breach of these Terms or for non-payment. Upon termination you remain liable for fees accrued.

12. Changes

We may change these Terms by posting a revised version on this page and updating the "last updated" date. Material changes are communicated by email at least 14 days before they take effect.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles.
